'Ziggy's BIG competition' Terms and Conditions

    Introduction

  1. By submitting an entry to ‘Ziggy’s BIG competition’ (by Road Safety Scotland), entrants agree to be bound by these Terms and Conditions.
  2. Conditions of Participation

  3. Entry instructions form part of these Terms and Conditions. Entries submitted with incomplete information, or found to contain invalid information, shall be deemed invalid entries.
  4. Entry is open to all nursery and primary 1 classes in Scotland. Directors, management and employees (and the immediate families of directors, management and employees) of Road Safety Scotland or agencies or companies associated with this competition are not permitted to enter the competition.
  5. To enter, entrants must sign up at www.gosafewithziggy.com/competition and complete the two part competition by completing Ziggy’s Fun Day Out and Safety Song and Dance.
  6. Upon sign up you will need to provide a username and password when doing so. You must ensure that you keep your username and password secret and that you do not disclose them to anyone as you will be responsible for all activities which occur under your username and password. It is your responsibility to notify us immediately of any unauthorised use of your username or password or any other breach of security as soon as you become aware of it.
  7. To finish entry entrants must:
    1. Complete ‘Ziggy’s Fun Day Out’ story creator by customising the story with their class road safety journey and provide photos/drawings of their road safety walk together.
    2. Record their class doing ‘Ziggy’s Zab-a-Ding-a-Doo’ Safety Song and Dance and submit it by uploading a photo, audio recording or short video via the website.
  8. Please note that any video entries will be hosted on the Go Safe with Ziggy YouTube account for accessibility reasons. Videos are uploaded as ‘unlisted’ so are not open to the general public and will only ever be viewable in the competition gallery.
  9. Before an entrant’s Fun Day Out story or Safety Song and Dance appear on the website, all submissions will be reviewed by Road Safety Scotland and will be accepted or rejected at Road Safety Scotland’s discretion.
  10. All entries featuring children must have the parents or carer’s permission. This permission is the responsibility of the nursery or school to ensure this is in place prior to entry.
  11. By signing up to enter you are agreeing to be contacted via email with regards to the competition and future competitions.
  12. Upon sign up entrants will be sent one Competition Pack which will be mailed using the postal address provided.
  13. Upon completion of the two part competition entrants will automatically be entered into the competition and will be emailed one online Competition Certificate and mailed one My Journey with Ziggy pack using the email and postal address provided.
  14. One entry per nursery or primary 1 class in the competition period (based on nursery or school name and class name). Nursery or primary schools may enter as many different classes as they wish.
  15. Online entry only. Internet access required.
  16. No automated, third party or bulk entries are permitted. Multiple entries in breach of this provision will result in those entries being disqualified.
  17. Upon submission of an entry, entrants assign in full/grant Road Safety Scotland a sole, perpetual, worldwide, unlimited, freely assignable, royalty free license in any intellectual property rights or other rights vested in the entry.
  18. The competition commences at 12:00am on 25th September 2017 and closes at 11:59pm on 7th May 2018 (being the “Promotion Period”). For the avoidance of doubt, this means that entries must have been received by Road Safety Scotland by the close of the Promotion Period in order to meet the closing date validity requirements.
  19. The winner will be selected by a panel that includes at least one independent member, to be held on 14th May 2017 (the “Selection Date”). (Details of panel members may be obtained (after the Selection Date) by writing to Road Safety Scotland). The panel with assess all valid entries. The entry that the majority considers in their subjective opinion to be the most energetic and creative shall be deemed the winning entry (the “Winner”) and receive the Prize. There will also be 32 Runners Up prizes. One per Local Authority area.
  20. The Winner and 32 Runners Up will be notified of the fact that they have won within 7 days of the Selection Date by email. They will then be asked to supply details for delivery of their prize. Prizes shall be delivered within 30 days of the Closing Date.
  21. Road Safety Scotland will use reasonable endeavours to contact the Winner and Runners Up using the contact details supplied upon entry to the competition. If a Winner (or Runner Up) does not respond within 3 calendar months of the first notification, then that individual forfeits the right to claim the Prize (or Runner Up Prize) and Road Safety Scotland is free to nominate another winner or runner up.
  22. Road Safety Scotland reserves the right to cancel, amend, terminate or temporarily suspend this competition at any time with no liability to any entrant or any third party.
  23. The following prizes are available to be won: 1 overall prize – deluxe road safety kit, a child-friendly digital camera plus a special visit to the nursery/school class from Ziggy and 32 Runner Up prizes – 1 recordable button.
  24. No cash or alternative prizes are available, with the exception that in the event of circumstances outside of its control, Road Safety Scotland reserves the right to award similar prizes of equal value.
  25. The visit to the nursery/school from Ziggy will be arranged at a mutually suitable date and time between Road Safety Scotland and the winning nursery/school.
  26. At the time of the visit to the nursery/school from Ziggy the winner agrees to the class being filmed doing the song and dance and using the film for further promotional activity.
  27. If for any reason any aspect of the competition does not function correctly, whether by means of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of Road Safety Scotland that corrupts or affects the administration, integrity or fairness of the competition, then Road Safety Scotland may at its sole discretion cancel, modify or suspend the competition and invalidate affected entries.
  28. Road Safety Scotland and its associated agencies and companies accept no liability for any loss, expense or damage which is suffered or sustained in connection with the competition and/or prizes.
  29. If there are reasonable grounds to believe that there has been a breach of these Terms and Conditions by an entrant, Road Safety Scotland may, at it's sole discretion invalidate the relevant entry and disqualify the entrant from the competition, irrespective of the stage in the Promotion reached.
  30. Road Safety Scotland’s decision in all matters relating to the competition is final and binding and no correspondence will be entered into.
  31. The Winners and Runners Up agree to take part for free in any publicity for the Promotion as requested by Road Safety Scotland.
  32. Names and cities/towns of the Winner and Runners Up will be available upon request after the selection date in writing to Road Safety Scotland, marked “Winners List – Ziggy’s BIG competition”.
  33. Entrants must seek the permission of their employer before entering this competition.
  34. The availability of the Competition Packs and My Journey with Ziggy packs are restricted to one each per nursery or primary 1 class.
  35. The Promoter is Transport Scotland, Road Safety Scotland, Transport Policy Directorate, Transport Scotland, 4th Floor Pentland House, 47 Robb’s Loan, Edinburgh EH14 1TY.
  36. Entries must be the entrant’s own original creations, not in violation of third party intellectual property rights, and if the entries do incorporate any third party elements, entrants must have the permission of the right holder to do so prior submission.
  37. Entries must not contain any elements that are or are likely to be perceived as: offensive; of an explicit sexual nature; depictions or descriptions of graphic violence; sexist; racist; homophobic; commercially sensitive; defamatory; in breach of the rights of others; or otherwise illegal, unacceptable or inappropriate content.
  38. Personal Information

  39. Road Safety Scotland will only collect personal information for the purposes of managing and administering ‘Ziggy’s BIG competition’. The personal information will not be used for any other purpose without the participant’s consent. This will not affect existing marketing preferences participants may have with Road Safety Scotland.
  40. By participating in ‘Ziggy’s BIG competition’, each participant consents that their personal information may be transferred to Road Safety Scotland’s service providers and agents (including their sub-contractors) to store and use as necessary to administer ‘Ziggy’s BIG competition’. Road Safety Scotland will never provide a participant’s personal information to third parties for them to use in their own direct marketing, without the participant’s consent.
